CANCELLATION
Cancellation or changes to a booking must be received by email 10 days prior to the date of the booking or the course commencing, after which time clients will forfeit their fee.
Mersea Island Watersports reserves the right to cancel a course or session or change availability dates due to weather conditions, or any other issues that affect safety. In these instances, alternative dates will be offered or a full refund will be issued. We reserve the right to change lesson type from group to private if the minimum attendance amount is not met or shorten the course accordingly.
Weather conditions. We will contact you in case of adverse weather or inadequate conditions – once a lesson is booked presume it will go ahead unless we contact you.
HEALTH & SAFETY
Mersea Island Watersports does not accept any responsibility for any personal injury, loss or damage.
Risk assessments have been carried out on all locations that our courses take place. Your instructor will make you aware of these and will be happy to discuss any concerns should you have any.
Any person having tuition must be medically fit to participate in their chosen water sport and be confident and comfortable in the water. If you have any medical condition or take a medication that affects the activity you must inform us and your instructor before starting any course. You must not participate in any lesson under the influence of drugs or alcohol.
Whilst on a MIW course you must observe the instructors safety guidance for your safety and the safety of others. There is an element of risk with any water sport, and the instructor is there for your safety, so their instructions must be followed to avoid exposure to any unnecessary risks.
Hiring
If you are hiring from us you must be competent to do so. Mersea Island Watersports reserves the right to refuse hire to persons unable to demonstrate competency if asked. We will terminate the session of anyone who is acting in a way that endangers themselves or others.
YOUTH/Children’s Sessions
Any child under 11 years must have a parent/guardian on site at all times. For children over 11 years parents/guardians can leave the site whilst their child is under instruction but must leave a contact telephone number and collect as the lesson finishes. Any child who behaves in a way that endangers themselves or others will be removed from the water and parents/guardian called to collect them. We reserve the right to take your child off the water if they refuse to follow instructions and/or are behaving in a way that is a danger to themselves or others. A refund will not be given in these circumstances.
We reserve the right to combine sessions based on number of participants, Shrimp and Starfish sessions may become one group and Young Teens and Older Teens also.
PHOTOGRAPHY
You agree to grant to Mersea Island Watersports (MIW) and its authorised representatives permission to record on photography film and/or video, pictures of my or my child’s participation. I further agree that any or all of the material photographed may be used, in any form, as part of any future publications, brochure, printed materials, website or social media used to promote MIW, and further that such use shall be without payment of fees, royalties, special credit or other compensation.
PRIVACY POLICY
IN GENERAL
This Privacy Policy governs the manner in which Mersea Island Watersports collects, uses, maintains and discloses information collected from users (each, a “User”) of the http://www.mersea-island-watersports.co.uk website (“Site”). This privacy policy applies to the Site and all products and services offered by Mersea Island Watersports.

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, or make a booking via our Site. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personal identification information, except that it may prevent them from engaging in certain Site related activities including purchasing from the shop.

In addition to cookies required for essential site functionality (i.e customer logins), our site employs Google Analytics in order to help us give you the best possible experience. Mersea Island Watersports collects and uses Users personal information for the following purposes:
The email address Users provide for booking processing, will be used to send them information and updates pertaining to their booking. It may also be used to respond to their enquiries, and/or other requests or questions. It may be used to send the User information about future events and offers available to them. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or User may contact us via our Site.
HOW WE PROTECT YOUR INFORMATION
We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorised access, alteration, disclosure of your personal information, transaction information and data.
Sensitive and private data exchange between the Site and its Users happens over a SSL secured communication channel and is encrypted and protected with digital signatures.

Data Privacy Notice (GDPR)

Identification can be by the information alone or in conjunction with any other information in the data controller’s possession or likely to come into such possession. Mersea Island Watersports (hereinafter MIW) is a registered company which was established in 2013. The safeguarding and processing of personal data is the responsibility of the Directors or their Data Controller who works for MIW. This means he or she is responsible for how your personal data is processed and for what purposes.
3. How do we process your personal data?
MIW complies with its obligations under the “GDPR” by keeping personal data up to date; by storing and destroying it securely; by not collecting or retaining excessive or unnecessary data; by protecting personal data from loss, misuse, unauthorised access and disclosure and by ensuring that appropriate technical measures are in place to protect personal data.

- Processing is carried out by MIW staff specified below on the basis that –
the processing relates only to members, former members, current clients and previous clients; and

Your personal data will be treated as strictly confidential and will be accessible only to the Directors and designated staff.
6. How long do we keep your personal data?
We retain data whilst it is still current; whilst people are still members or where they have been within the previous 18 months or where people are current clients or have been within the previous 18 months.
7. Your rights and your personal data?
Unless subject to an exemption under the GDPR, you have the following rights with respect to your personal data:-
- The right to request a copy of the personal data which MIW holds about you;
- The right to request that MIW corrects any personal data if it is found to be inaccurate or out of date;
- The right to request that your personal data is erased where it is no longer necessary for the MIW to retain such data e.g. if you have stopped your Membership;
- The right to withdraw your consent to the processing at any time;
- The right, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction is placed on further processing;
- The right to lodge a complaint with the Information Commissioners Office.
8. Further processing
If we wish to use your personal data for a new purpose, not covered by this Data Protection Notice, then we will provide you with a new notice explaining this new use prior to commencing the processing and setting out the relevant purposes and processing conditions. We will seek your prior consent to any such new processing.
9. Website Cookies
A cookie is a small text file that is downloaded onto a computer or smartphone when the user accesses a website. It allows the website to recognise that user’s device and store some information about the user’s preferences or past actions. The MIW website does not currently use cookies. If this changes in the future, you will be notified.
